Your assessment of the judiciary is unfair – JUSSAG president tells Mahama
Former President Mahama’s strongly held position that the image of the judiciary has been dented and broken which requires a new person at the helm of affairs of the institution has been deemed as unfair by Mr Alex Nartey president of the Judicial Service Staff Association of Ghana (JUSAG).
Mr Nartey said this during a discussion on Citi TV when he was commenting on the former president’s perception of the judiciary. “I think that such a statement is not fair to the judiciary… and I think he must be fair to the Chief Justice,” Mr Nartey said.
“He [Chief Justice] has not changed any of the procedures. He has not altered any of the laws based upon which these decisions are taken,” he added.
Also, he pointed out to Mr Mahama that he needs to make a clear distinction by not mixing up his disagreement with the court with a verdict delivered by a biased judge.
“The fact that you disagree with the judgment does not mean the judge who rendered that decision has no integrity,” he said.
He further pointed out options available to challenge verdicts you do not agree with from the courts.
Stressing that the fact in the instance where a decision by the court does not go your way does not mean something untoward has been done that cannot be cured by law.
Also, a Member of the National Democratic Congress legal team contributing to the discourse said the judiciary is not sacrosanct and therefore can be constructively criticized if people do not agree with some of their decisions.
“It is when you are criticised that you will make you refined or fine-tune what you do,” he said.
Mr Adawudu then complained that unnecessary light was being shed on the Chief Justice in the discussion of Mr Mahama’s remarks.
