Supreme Court adjourns Assin North MP case
The supreme court of Ghana has on Tuesday July 12, 2022 adjourned the case involving the Member of Parliament for Assin North, James Gyakye Quayson.
The ruling which has indefinitely led to the adjournment of the case according to the court, is to allow the defendant to file written submissions to strike out the inherent decision of the highest court of the land.
A private citizen, Michael Ankomah Nimfah had applied to the Supreme Court for the interpretation of Article 942)(a) of the 1992 Constitution following 2020 Parliamentary elections.
“The petitioner is arguing that Mr Gyakye Quayson, at the time of filing his nomination to contest the Assin North parliamentary seat, was holding dual citizenship, contrary to the dictates of the 1992 Constitution.
The petitioner therefore asked the court to declare that the Electoral Commission breached Article 94(2)(a) of the 1992 Constitution when it permitted Mr Quayson to contest in the 2020 elections.”
However, on Tuesday, July, 12, 2022 Counsel for the Assin North MP, Lawyer Tsatsu Tsikata filed a motion for the preliminary objection of the interpretation.
Subsequently, Justice Jones Dotse, president of the supreme Court deferred the case indefinitely after hearing no objections from the Attorney General’s department, the plaintiff’s attorney, or the Electoral Commission. This is to allow the defense to submit a written arguments within 14 days.
