Special Prosecutor drops case against Mahama Ayariga

Special prosecutor Kissi Agyabeng has dropped the case against Bawku Central MP Mahama Ayariga.

On Monday, October 11, the new Special Prosecutor told the media that it will be a waste of time for the state to continue with the case because it will suffer the same fate as it did when former Special Prosecutor Martin Amidu sent it to court.

“It will be a complete waste of time if we were to open this case further and go to a length where it will only be dismissed on the submission of no case to answer,” Mr Kissi Adjabeng said.

Mr Mahama Ayariga was being prosecuted with six others on seven counts of conspiracy, abetment, contravention of the procedure for request for quotation, using public office for-profit and transfer of foreign exchange from Ghana through an unauthorised dealer.

However, the Bawku Central Member of Parliament through his lawyers submitted an application of no case when he was arraigned before court, which was upheld and got him acquitted and discharged from all charges on May 7, 2021, by the Accra High Court presided over by Justice Afia Serwah Asare–Botwe.

Meanwhile, Counsel for the MP, Godwin Edudzi Tamakloe has welcomed the decision saying he was not surprised by the outcome.

“He [Special Prosecutor] indicated that the evidential standard required in a criminal trial is proof beyond reasonable doubt and he is unable to do that with the evidence available to him. We are grateful to him and the courts for what has happened today,” he said.
