Supreme Court orders Anas Aremeyaw Anas to testify in-camera against Kwesi Nyantakyi

The Supreme Court today has quashed a High Court decision in the case against former GFA President Kwesi Nyantakyi. The court has ruled that the revered investigative journalist would have to testify in court without any privileges.

An Accra High Court had earlier granted an oral application by the prosecutor for Anas Aremeyaw Anas to testify in-camera as a prosecution witness in the criminal case of the Republic v Kwesi Nyantakyi & Another. Kwesi Nyantakyi’s lawyers challenged the ruling by filing a certiorari at the Supreme Court.

Thadeus Sory of Sory @Law, lead counsel for the ex-FIFA Council Member argued that the High Court’s order offended the human rights of the applicant as guaranteed under the 1992 Constitution, was made without regard to the procedures and rules of the court which required that a formal and not an oral application be made in such circumstances and also the order was beyond the jurisdiction of the court.

Justice Baffoe-Bonnie who presided over the case gave the order on Tuesday, November 8, 2022, ordering Anas Aremeyaw Anas to testify publicly as a prosecution witness without privileges.
