Court throws out Francis-Xavier Sosu’s injunction suit against IGP Akuffo Dampare
An Accra High Court has dismissed a plea for interlocutory injunction brought by Francis Xavier Sosu, Member of Parliament for Madina, against the Inspector General of Police, Dr George Akuffo Dampare.
In denying the request, on Monday, March 28, 2022, presiding judge Barbara Tetteh-Charway described the application as “inappropriate” in light of the substantive application before it.
In November 2021, the Madina MP reported and described the two efforts by the Ghana police to get him arrested as unlawful arrest and violation of his human rights as a Ghanaian.
According to Francis Sosu, Article 33 of the Constitution safeguards his rights against fraudulent, frivolous, and malicious arrests and prosecutions.
He further noted that the Police Service’s administrative functions to arrest, investigate, and prosecute him did not meet the high standards of fairness, reasonableness, and compliance set forth in Article 23 of the Constitution of 1992.
Also, he revealed that since the start of the police’s arbitrary and unlawful actions, he has “suffered incalculable losses, including mental and psychological stress; his wife, children, and parents have been severely traumatized; and his career as an MP has been severely harmed”.
However, Justice Barbara Tetteh Charway upon calling the case on Monday, March 28, 2022, ordered the parties to provide written submissions by April 15, 2022, for the court to meet on April 27, 2022, to set a judgment date.
