Chief Justice grants Kennedy Agyapong request to have Justice Baah sit on Anas case
Kwesi Anin-Yeboah, the Chief Justice, has approved a request by Kennedy Ohene Agyapong, Member of Parliament for Assin Central Constituency, to have judge Eric Baah retained in a defamation case involving renowned investigative journalist Anas Aremeyaw Anas.
After Justice Gifty Addo was substantively asked to hear the matter, the New Patriotic Party (NPP) politician purportedly wrote to the Chief Justice, through his attorneys, requesting that Justice Eric Baah be brought back.
As an additional High Court Judge, Justice Baah, a Court of Appeal judge, had sat on the case before.
However, on Tuesday, October 19, the defendant’s lead lawyer petitioned the Chief Justice to have Justice Baah retained, claiming, among other things, that Justice Gifty Addo “does not have the benefit of the witnesses’ demeanour so far.”
Justice Anin-Yeboah wrote to Justice Baah on Wednesday, October 27, requesting that the case be continued by him to its conclusion.
However, Anas Aremeyaw Anas’ lawyers are astonished by the news, claiming that they were unaware of it.
They stated that “On 1st December 2021 when lawyers of Anas appeared in court for business, the Court referred them to another court on grounds that the matter is no longer before the substantive judge and that the CJ has acceded to the request by Mr. Agyapong for the Eric Baah, J.A to continue to sit on the case”.
Mr Agyapong’s cross-examination has been postponed until Thursday, December 16.
Anas sent the loudmouth MP to court in a defamation case worth GHS25 million, alleging that the latter caused him dissatisfaction in the Number 12 documentary attacks.
